Domestic Violence Cases
Police will take someone to jail - Know what to do next
One case that often needs to be aggressively pursued is domestic violence. The arresting officer is mistakenly under the impression that someone must go to jail. The client usually spends the weekend in jail and then bonds out on Monday. Since domestic violence cases are a high priority, trial is set within 4 to 6 weeks. Be sure to demand a Jury Trial at your first appearance. This is often before you retain an attorney. Viable defenses are available for these cases, such as self-defense and in some circumstances, provocation. The downside to pleading guilty is substantial, including 36 weeks of classes, and permanent restraining order which can impact your ability to seek future reemployment, not to mention a conviction for a “violence-related” crime.
